Whitelist of Producers and Exporters

The main purpose of this whitelist is to support the identification, protection and enforcement of the rights of NativaLand breeders in Europe and the United Kingdom in relation to their proprietary sweet potato varieties.

NativaLand is the owner/licensor of rights over a portfolio of protected sweet potato varieties, including (Bellevue, Orleans, Bayou Belle, Evangeline, Burgundy, Beauregard, Vermillion, Radiance, Sakura, Murasaki and Bonita). These varieties are subject to specific licensing agreements and are not intended to be freely available for propagation, production or commercial export without restrictions.

For the purpose of protecting NativaLand breeders’ rights, the relevant exporters and producers are identified through a controlled whitelist, based on the licensing agreements granted for NativaLand varieties.

Each exporter or producer has its own individual licensing agreement with NativaLand. The licence is specific to that entity and sets out the varieties it is authorised for, as well as the applicable authorised quantities and other relevant contractual conditions.

Accordingly, inclusion on the whitelist must not be interpreted as a general or open licence to produce, propagate, sell or export NativaLand varieties. Authorisation is limited to the specific varieties and quantities covered by the relevant individual licensing agreement.

The whitelist therefore makes it possible to distinguish between:

1. Authorised production and export — where the exporter/producer holds a valid licence covering the relevant NativaLand variety and quantity; and

2. Unauthorised production or export — where the relevant variety is being produced, propagated, marketed or exported without the necessary rights or outside the scope of the applicable licence.

This distinction is particularly important for monitoring the movement and marketing of NativaLand varieties in European countries and the United Kingdom, as well as for identifying potential activities that may be outside the scope of the rights granted under NativaLand breeders’ rights and licensing agreements.

Licensing Principle

The whitelist is therefore licence-, variety- and quantity-specific. A licence granted to a particular exporter or producer does not automatically authorise any other entity, nor does authorisation for one NativaLand variety extend to other varieties.

Likewise, a quantity authorised under a given agreement cannot be interpreted as an unlimited right to produce or export additional quantities.

The purpose of maintaining this controlled whitelist is therefore to provide a clear reference point for determining whether the production, propagation and/or export of a given NativaLand variety in Europe or the United Kingdom is covered by an existing licence or is potentially outside the scope of the rights granted by NativaLand.
